Australian Overtime and Penalty Rates 2025: Know Your Rights
Australia's Fair Work Act guarantees minimum penalty rates for overtime, weekend and public holiday work. These rates apply to most award and enterprise agreement employees, though the specific rates depend on your industry award.
Standard Penalty Rates — General Retail and Hospitality (indicative)
| Day/Time | Permanent Rate | Casual Rate |
|---|---|---|
| Weekday overtime (first 2hrs) | 1.5× | 1.75× |
| Weekday overtime (beyond 2hrs) | 2.0× | 2.25× |
| Saturday | 1.25× (first 2hrs) | 1.50× |
| Sunday | 1.75–2.0× | 2.0–2.25× |
| Public Holiday | 2.5× | 2.75× |
Note: Rates vary by award. The rates above are indicative General Retail Industry Award rates. Check your specific award at fairwork.gov.au.
Casual Loading
Casuals receive a 25% loading on top of the base rate instead of leave entitlements. This loading is applied before penalty rate multipliers — so a casual Sunday rate of 2.0× base becomes 2.0× the casual rate (which already includes the 25% loading).
Minimum Wage July 2025
The National Minimum Wage increased to $24.10 per hour from 1 July 2025 — a 3.5% increase. This flows through to most modern award minimum rates. If you're on the minimum wage, this is your base rate for all overtime calculations.
Rates are indicative based on common award structures. Always check your specific Modern Award at fairwork.gov.au for exact rates. Not legal or financial advice.
